§ 155.30. EMERGENCY ACTION.

  • (A) If, in any instance, the Unsafe Building Department shall find that it is necessary to take emergency action with reference to unsafe premises in order to protect life, safety, or property, the Unsafe Building Department, may cause action as is necessary to protect life, safety, or property to be performed without issuing an order or giving notice.
    (B) Such emergency action shall be limited to removing any immediate danger. The cost incurred by the Unsafe Building Department in taking or having such action taken may be recovered against the persons who have a fee interest or life estate interest in the unsafe premises by filing of a civil action in the Lake County Circuit, or Superior Court by the Unsafe Building Department. Cost of the action shall not be borne by either the Unsafe Building Department, or any other Department of the County of Lake, State of Indiana.
